INFINIT Nutrition Australia ABN 40 453 541 361 ("INFINIT Nutrition Australia", "we", "us" or "our") operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience and custom formulated sports nutrition and hydration products (the "Services"). We manufacture our products on the Sunshine Coast, Queensland, and supply customers in Australia, New Zealand, Singapore, Hong Kong and Thailand. INFINIT Nutrition Australia is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, hold, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.
We are bound by the Privacy Act 1988 (Cth), including the Australian Privacy Principles (APPs). Where we collect or hold personal information about people in New Zealand, or in the course of carrying on business in New Zealand, we also comply with the Privacy Act 2020 (NZ), including the Information Privacy Principles (IPPs). This Privacy Policy explains how we handle personal information in line with both laws.
Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described in this Privacy Policy. Where the law requires your consent (for example, to collect health information used to formulate your custom products, or to send you marketing messages), we will ask for it separately, and you can withdraw it at any time by contacting us.
Personal Information We Collect or Process
When we use the term "personal information," we are referring to information or an opinion that identifies or can reasonably be linked to you or another person, whether or not it is true and whether or not it is recorded in a material form. Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you. We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with the Services, where you live, and as permitted or required by applicable law:
- Contact details including your name, address, billing address, shipping address, phone number, and email address.
- Financial information including credit card, debit card, and financial account numbers, payment card information, financial account information, transaction details, form of payment, payment confirmation and other payment details. Card payments are processed by our payment providers (such as Shopify Payments) in line with the Payment Card Industry Data Security Standard (PCI DSS). We do not store your full card number on our own systems.
- Account information including your username, password, security questions, preferences and settings.
- Transaction information including the items you view, put in your cart, add to your wishlist, or purchase, return, exchange or cancel and your past transactions.
- Custom formulation and performance information including your sport or event, training volume and intensity, body weight, sweat rate and sweat sodium results, flavour, carbohydrate and caffeine preferences, dietary requirements, food allergies or intolerances, and any health conditions or medications you choose to tell us about so that we can formulate a product that is safe and suitable for you.
- Team, club and business information where you order on behalf of, or as part of, a team, club, event or business (for example, the names and formulation details of athletes in a team order), and business details such as an ABN or NZBN for wholesale, private label and reseller customers.
- Reviews and content including product reviews, survey responses, competition entries, and photos, videos or athlete stories you agree to share with us.
- Communications with us including the information you include in communications with us, for example, when sending a customer support inquiry or speaking with our formulation team.
- Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.
- Usage information including information regarding your interaction with the Services, including how and when you interact with or navigate the Services.
Health and Sensitive Information
Some of the information you give us to create a custom formula, such as health conditions, allergies, medications or body composition, is "health information" and "sensitive information" under Australian privacy law and is treated with particular care under New Zealand privacy law. We only collect this information with your consent and where it is reasonably necessary to formulate, manufacture and supply your product. We use it only for that purpose and for product safety and quality. We never use it for marketing or advertising, and we never share it with advertising, affiliate or marketing partners.
Our custom formulations are sports foods. They are not intended to diagnose, treat, cure or prevent any disease or medical condition, and our formulation advice is not medical advice. If you have a medical condition, are pregnant or breastfeeding, or take medication, please speak with your doctor or an Accredited Sports Dietitian before using our products.
Dealing With Us Anonymously
Where it is lawful and practicable, you can deal with us without identifying yourself or by using a pseudonym, for example when making a general enquiry. We will usually need your name, contact details and delivery address to process an order, and we cannot create a custom formula without the information it is based on. If you choose not to give us information we ask for, we may not be able to process your order, create a safe and suitable custom product, respond to your enquiry or provide some of the Services.
Personal Information Sources
We may collect personal information from the following sources:
- Directly from you including when you create an account, visit or use the Services, complete a formulation questionnaire or sweat test, communicate with us, or otherwise provide us with your personal information;
- Automatically through the Services including from your device when you use our products or services or visit our websites.
- Cookies, Pixels, Scripts, and Similar Technologies. We and our service providers or marketing partners may use cookies, pixels, scripts, tags, and similar technologies to recognise your browser or device, understand how visitors interact with our website, measure advertising and affiliate marketing performance, attribute purchases to partners, and improve our Services. You can control or delete cookies through your browser settings and, where available, through the cookie settings on our website. Blocking some cookies may affect how the website works.
- From our service providers including when we engage them to enable certain technology and when they collect or process your personal information on our behalf;
- From our partners or other third parties, such as a coach, team manager, club, event organiser, retailer or business customer who places an order that includes your details, our affiliate and referral partners, and payment and fraud prevention providers.
Where we collect information about you from someone else, we will take reasonable steps to let you know, as required by APP 5 and by IPP 3A of the New Zealand Privacy Act 2020. If you give us personal information about another person (for example, athletes in a team order), you must have their permission to do so and should let them know about this Privacy Policy. For anyone under 18, that permission must come from their parent or guardian.
How We Use Your Personal Information
Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:

Automated Decisions
We use some computer programs that use personal information to make, or help make, decisions that could affect you. These include:
- Fraud screening tools provided by Shopify and our payment providers, which use your order, payment, device, IP address and location information to assess the risk of an order and may flag, hold or cancel an order that appears high risk.
If you think an automated decision about you is wrong, please contact us and a member of our team will review it.
How We Disclose Personal Information
We do not sell your personal information. In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances may include:
- With Shopify, vendors and other third parties who perform services on our behalf (e.g. IT management, payment processing, data analytics, customer support, cloud storage, fulfilment and shipping).
- With business and marketing partners to provide marketing services and advertise to you. For example, we use Shopify to support personalised advertising with third-party services based on your online activity with different merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices.

This may include sharing or making available information such as referral source, website activity, discount code usage, purchased products, order value, transaction details, return or refund status, and related attribution data. These partners may process information according to their own privacy notices. We never share your health or custom formulation information with business, marketing or affiliate partners.
- When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.
- With regulators and authorities where required or authorised by law, including food safety regulators such as Food Standards Australia New Zealand, Queensland Health and New Zealand Food Safety in the event of a recall or food safety investigation.
- With our professional advisers (such as accountants, auditors, insurers and lawyers) and with certification and audit bodies that review our food safety and quality systems, who are bound by confidentiality obligations.
- In connection with a business transaction such as a sale, merger, restructure or insolvency, to comply with any applicable legal obligations (including to respond to orders, warrants, regulator notices and similar requests), to enforce any applicable terms of service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.
Relationship with Shopify
The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you (see International Transfers below). In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. To learn more about how Shopify uses your personal information and any rights you may have, you can visit the Shopify Consumer Privacy Policy. Depending on where you live, you may exercise certain rights with respect to your personal information through the Shopify Privacy Portal.
Third Party Websites and Links
The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.
Children and Young Athletes
Our Services are intended for adults. We do not knowingly collect personal information directly from anyone under 18 without the involvement of a parent or guardian. Where a product for a young athlete is ordered by a parent, guardian, school, club or coach, we collect only the information needed to formulate and supply that product, and we ask the person placing the order to confirm they have the parent or guardian's consent. Under the Australia New Zealand Food Standards Code, formulated supplementary sports foods must state that they are not suitable for children under 15 years of age or pregnant women and should only be used under medical or dietetic supervision. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.
Security and Retention of Your Information
We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include encrypted connections on our website, using reputable hosting and payment providers, limiting access to staff who need it, multi factor authentication on key systems, staff privacy and confidentiality training, and secure storage and disposal of paper records, such as formulation sheets, at our manufacturing facility. Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.
If a data breach involving your personal information is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner under the Notifiable Data Breaches scheme and, for New Zealand customers, the Office of the Privacy Commissioner, as required by law.
How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide you with Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies. For example, we keep financial and tax records for at least 5 years in Australia and 7 years in New Zealand as required by tax law, and we keep batch, formulation and traceability records for 3+ years to meet our food safety and recall obligations. When we no longer need personal information, we take reasonable steps to securely destroy it or permanently anonymise it.
Your Rights and Choices
Under Australian and New Zealand privacy law, you have the right to ask for access to the personal information we hold about you and to ask us to correct it. Depending on where you live, you may also have some or all of the other rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

Before accepting such a request from an agent, we will require that the agent provide proof you have authorised them to act on your behalf, and we may need you to verify your identity directly with us. When we disclose personal information to overseas recipients, we take reasonable steps, including through contractual terms, to ensure they handle it in a way that is consistent with the Australian Privacy Principles. For New Zealand customers, we only disclose personal information overseas where permitted by IPP 12, for example where the recipient is subject to privacy safeguards comparable to New Zealand law, or where you have authorised the disclosure after we have told you it may not be protected in a comparable way.
